1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the SayMelo mobile application (the "App") operated by DaelVista LLC ("we," "our," or "us"). By downloading, installing, or using SayMelo, you agree to these Terms. If you do not agree, do not use the App.

2. Eligibility

SayMelo is intended for users at least 13 years old. If you are under the age of majority where you live, use the App only with the consent and supervision required by applicable law. SayMelo is a general-audience educational product and is not directed to children.

3. Description of the Service

SayMelo provides English-learning content, real-life situations, Practice tools, speaking features, progress features, and selected AI-powered features. Educational content is generally free. Practice requires sign-in.

• Free access: Authenticated Free users receive 3 shared normal Practice sessions per day.
• Pro access: Pro is subscription-based and provides normal Practice without the visible Free daily cap, subject to reasonable fair-use and anti-abuse protections.
• AI features: Some AI features have separate Free tasting or usage limits. Certain features, including Tone Master, AI Review, AI Custom Practice, AI Coach, and Weekly Insight, are Pro features.
• Educational feedback: AI-generated output and speech feedback are educational aids and may be inaccurate.

4. Google Play Subscriptions

4.1 Products and pricing

Approved Pro subscription products are pro_monthly and pro_annual. Subscriptions are processed through Google Play. Prices are displayed by Google Play in the user's local currency where applicable, and the exact price and billing terms shown at checkout are authoritative. SayMelo does not publish a globally canonical fixed USD price for these subscriptions.

4.2 Annual trial offer

Eligible users may receive a 7-day free trial on the Annual plan when offered by Google Play. Not every user will receive a trial. The exact price, eligibility, and billing terms are shown at checkout. The Annual subscription then renews at the price shown by Google Play unless cancelled.

4.3 Renewal, cancellation, and access

• Subscriptions automatically renew unless cancelled through Google Play before the applicable renewal point.
• You can manage or cancel a subscription through your Google Play account settings.
• Cancellation normally preserves Pro access until the end of the current paid or trial period.
• Pro access depends on an active and valid subscription and may be subject to Google Play, service, fair-use, and anti-abuse controls.
• Deleting your SayMelo account does not automatically cancel a Google Play subscription. Manage or cancel the subscription separately through Google Play.

4.4 Billing and refunds

Google Play handles subscription billing and applicable refund processes. Refunds and billing disputes are subject to Google Play policies where applicable. SayMelo does not make guarantees beyond those policies and applicable law.

5. Account and Data

5.1 Sign-in

Practice requires sign-in. Sign-in may be provided through the authentication options made available in the App. You are responsible for keeping your account credentials secure and for providing information that is accurate enough to operate the account.

5.2 Account deletion

You may request deletion through the in-app Delete Account & All Data flow. The current server-side deletion transaction removes the covered SayMelo account records, including learning, Practice, review, saved-item, mistake, Slang, AI-application, report-event, account/device, subscription-mirror, and legacy-credit records, and then removes the authentication account. Matching RevenueCat purchase-event records are removed, while selected operational records such as API-call logs and anonymous device-grant records are de-linked. If you cannot access the App, use the instructions at https://saymelo.com/delete-account or contact support@saymelo.com. Deletion does not automatically cancel a Google Play subscription.

Google Play, RevenueCat, AI and speech-processing providers, diagnostics providers, and other third parties control their own systems and retention. Limited SayMelo operational, security, financial, or legal records may also be retained where required.

6. AI and Speaking Features

When you use an AI or speaking feature, your submitted text, educational prompt, short microphone recording, transcript, or other minimum necessary content may be processed by SayMelo and by AI or speech-processing service providers. The feature may use a server-side proxy or other service infrastructure. Do not submit passwords, payment information, government identifiers, medical information, legal information, or other sensitive personal information.

Provider-neutral wording is sufficient for the current public legal disclosure. The deployed runtime supports more than one configured provider path, and the current selector values are not exposed by the safe production inspection available for this task. Naming a single provider would risk overstating a value that can change without a website edit.

6.1 Reporting AI and educational content

You may report incorrect educational content, inappropriate or harmful AI-generated output, or quality issues. Reports may be used for quality improvement, safety, content correction, and abuse prevention. A report may contain structured content metadata needed to identify the relevant feature or output, but it is not intended to include raw audio, complete private conversations by default, payment data, authentication tokens, advertising identifiers, device fingerprints, or an email address solely for the report.

6.2 Acceptable AI use

• Use AI features for language-learning and other permitted purposes described in the App.
• Do not submit illegal, harmful, hateful, sexually explicit, or abusive content.
• Do not submit sensitive personal information or information about another person without an appropriate legal basis or consent.
• Do not attempt to bypass access controls, rate limits, safety controls, or anti-abuse protections.
• Do not use bots, scripts, modified clients, or automated methods to disrupt or abuse the service.

7. Advertising

SayMelo does not intentionally show advertising in the current product model. We do not promise an advertising-supported access model. If the product changes, the relevant Terms, Privacy Policy, and store disclosures will be reviewed before the change is released.

8. Acceptable Use

You agree not to reverse engineer, decompile, disassemble, scrape, redistribute, resell, or commercially exploit the App or its content; interfere with the service; circumvent authentication or security controls; misuse another user's account; or use SayMelo for an unlawful purpose.

9. Intellectual Property

SayMelo's content, interface, code, design, trademarks, and branding are owned by DaelVista LLC or its licensors. We grant you a limited, personal, non-transferable, revocable license to use the App for your own lawful learning purposes. This license does not permit redistribution, commercial use, or reproduction of protected content.

10. Disclaimers

10.1 No warranty

SayMelo is provided on an "AS IS" and "AS AVAILABLE" basis to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or suitable for every learner.

10.2 Educational and AI limitations

SayMelo is an educational tool, not an accredited language school, clinical service, or source of guaranteed results. AI-generated content and speech feedback may contain errors and should be reviewed using your own judgment.

11. Limitation of Liability

To the fullest extent permitted by law, DaelVista LLC shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of the App. Our total cumulative liability for a claim arising from these Terms or the App shall not exceed the amount permitted by applicable law.

12. Termination

You may stop using the App at any time. We may suspend or terminate access if necessary to protect the service, comply with law, or address a material violation of these Terms. Subscription management remains with Google Play, and deleting a SayMelo account does not itself cancel a Google Play subscription.

13. Changes to Terms

We may update these Terms when the App, its access model, its providers, or legal requirements change. The effective date identifies the latest version. Material changes may be communicated through the App or another appropriate channel.

14. Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, United States, except to the extent applicable law provides otherwise. Before formal proceedings, contact us at support@saymelo.com so we can attempt to resolve the issue informally.
